Hamilton County will pay $500,000 to man seriously injured by jail officer

555 Hamilton County Sheriff Jim Neil and the county have agreed to pay $500,000 to a man who suffered a broken hip and concussion after a corrections officer shoved him headfirst into a jail cell structure. The county Board of Commissioners the settlement Wednesday, meeting minutes show. The incident happened in August 2016, and led to the resignation of the corrections officer, Jason Mize. The settlement, which resolves a federal lawsuit, says Mize is being investigated by the U.S. Department of Justice for criminal civil rights violations. It also alleges Neil's policies "were the driving force behind the constitutional violation." Neil did not admit liability. The man who was injured, Mark Myers, was 61 years old at the time. Myers was arrested Aug. 20, 2016 after being accused of walking out of a Columbia Township Home Depot without paying for $120 in lighting and electrical equipment - a charge that ultimately resulted in an acquittal. He said there had been a computer error related to an online payment he'd already made.
